The conditions that govern this site, the member platform, and the services reached through them.

Using this website or the services reached through it means you accept these terms. If you do not accept them, do not use the site or the services.
Where you have signed an engagement letter with us, that document governs the work. These terms cover everything around it.
2. What we provide
GlobalServer Capital provides private trust services, settlement execution, instrument issuance and monetization, project funding facilitation, gold sourcing, digital asset settlement, and related advisory work.
Every service is subject to eligibility checks, due diligence, and the laws that apply in the jurisdictions involved. Nothing on this site is an offer, a commitment to provide funding, or a guarantee that a particular transaction will be accepted.
3. Not investment advice
The content on this site, including the insights section, is general information. It is not investment, legal, tax, or accounting advice, and it does not take your circumstances into account.
Advice is given only under a signed engagement, in writing, and only to the client it was written for.
4. Who may use the services
Our services are for qualified institutions, accredited investors, and professional clients. They are not offered to retail clients.
By engaging us you confirm that you have the legal capacity to enter binding agreements, that you meet the eligibility criteria for the service in question, and that the information you have given us is accurate and complete.
5. Due diligence
We verify identity, beneficial ownership, and source of funds before acting. This is not optional and it is not a formality. Files where the source of funds cannot be evidenced are declined.
We may decline or discontinue an engagement at any point if diligence cannot be completed to our satisfaction, and we are not obliged to explain a decision where doing so would breach a legal duty.
6. Accounts and platform access
Access to the member platform is issued to an account that has completed onboarding. You are responsible for keeping your credentials confidential and for everything done under your account.
Tell us immediately if you believe your credentials have been compromised. Sharing access with anyone outside your authorised users is a breach of these terms.
7. What you must not do
You agree not to:
- Use the services for any unlawful purpose
- Launder money, finance terrorism, evade sanctions, or commit fraud
- Give us false, incomplete, or misleading information
- Attempt to gain unauthorised access to our systems or another client's data
- Interfere with, probe, or disrupt the platform or its infrastructure
- Present our documentation or confirmations as evidence of a transaction that did not occur
8. Fees
Fees are quoted in writing before work begins and are set out in the engagement letter. We do not charge fees that were not quoted.
Where a third party in a transaction charges its own fees, those are disclosed to you as soon as they are known to us.
9. Intellectual property
The content, trademarks, software, and documentation on this site and on the platform belong to GlobalServer Capital or are licensed to us. You may not copy, distribute, or create derivative works from them without written permission.
Documents produced for you under an engagement are yours to use for the purpose they were produced for.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or the services, including lost profits and lost opportunity.
Nothing in these terms limits liability for fraud or for anything else that cannot lawfully be limited.
11. Availability
The site and the platform are provided as they are. We do not warrant that they will be uninterrupted, error free, or available at any particular moment.
Scheduled maintenance is announced in advance to members where it is expected to affect access.
12. Suspension and termination
We may suspend or end access to the services where these terms are breached, where diligence cannot be completed, where we are legally required to, or where continuing would expose either party to unacceptable risk.
Obligations that by their nature survive termination, including confidentiality and record keeping, continue to apply.
13. Changes to these terms
These terms may be revised. The current version is always the one published here, dated at the top of the page. Material changes are notified to clients under a live engagement.
Continuing to use the services after a change means you accept the revised terms.
14. Governing law
These terms are governed by the law stated in your engagement letter. Where no engagement letter exists, they are governed by applicable international law and convention, without regard to conflict of law principles.
